Luvevolves DBA Powerplay Car Rental provides car rentals to Renter.

Renters agree by Renter signature on the Rental Agreement Summary (the

“Summary”), and/ or by clicking the “I Accept” via online check in

and/ or online rental reservation request has read, is aware of, accepts full

responsibility for and is bound by the terms and conditions contained in the

summary and these additional Terms and Conditions (collectively the

“Contract”), for the Rental Period. If Luvevolves DBA Powerplay Car Rental

assigns a new rental agreement number during the Rental Period for the

purpose of invoicing Renter, though subsequent agreements are not executed by

Renter, Renter acknowledges and agrees that the terms and conditions in this

Contract will govern for the period ending when Renter executes a subsequent

rental agreement. Renter agrees that electronic signatures have the same force

and effect as manual signatures. Renter expressly acknowledges that Renter

and Luvevolves DBA Powerplay Car Rental are the only parties to the Contract,

notwithstanding that a reservation for Vehicle may have been arranged by a

third party; that a third party may pay for all or part of the rental bill; and/or that

a third party may negotiate certain terms of the rental, including but not limited

to the type of Vehicle, length of rental, rental rate and/or selection of optional

products. For matters arising from the Contract, Renter authorizes Luvevolves

DBA Powerplay Car Rental to verify and/or obtain through credit agencies or

other sources Renter’s personal, credit and/or insurance information. The

Contract is the entire agreement between Renter and Luvevolves DBA

Powerplay Car Rental and cannot be altered by another document or oral

agreement unless agreed to in writing and signed by Renter and Luvevolves DBA Powerplay Car Rental.

By renting our vehicles, you agree to comply with, and be legally bound by, the

provisions of this additional terms and condition. These terms, together with

cancellation policy, nondiscrimination policy, terms of use, applicable insurance terms,

roadside assistance terms, the additional policies, the additional terms and

conditions constitute the “Agreement” between you and Luvevolves DBA

Powerplay Car rental.

Luvevolves DBA Powerplay Car Rental reserves the right, at our sole discretion,

to modify the Agreement, including additional polices, at any time. If we modify

these terms, we will post the modification on the terms. We will also update the

“Last Revised” date at the top of these terms. If you continue to use our car

rental or are in communications with us after we have posted a modification or

have provided you with notice of a modification, you are indicating that you

agree to be bound by the modified terms. If modified terms are not acceptable

to you, your sole recourse is to stop using our services.

Definitions

1.   “Rental Period” means the period between the time Renter takes possession

of Vehicle until Vehicle is returned or recovered and in either case, checked in

by Luvevolves DBA Powerplay Car Rental.

2.   “Renter” means the person, or entity identified on the Summary as

“RENTER”.

3.   “Vehicle” means the “ORIGINAL VEHICLE” or any vehicle(s), inclusive of

vehicle as equipped and furnished by the manufacturer and any equipment

added by Luvevolves DBA Powerplay Car Rental.

4. Luvevolves DBA Powerplay Car Rental/Vehicle Condition/Warranty

Exclusion. Renter acknowledges that Vehicle and any Optional Accessories are,

by Luvevolves DBA Powerplay Car Rental, beneficial interest or lease, property

of Luvevolves DBA Powerplay Car Rental or its affiliate, even if owned,

registered or titled to a third party. Renter is not an agent of Luvevolves DBA

Powerplay Car Rental and has no authority to bind Luvevolves DBA Powerplay

Car Rental. Renter agrees Renter received Vehicle and any Optional Accessories

in good physical and mechanical condition. RENTER IS TAKING POSSESSION

OF VEHICLE AND ANY OPTIONAL ACCESSORIES “AS IS” AND HAS HAD AN

ADEQUATE OPPORTUNITY TO INSPECT VEHICLE AND ANY OPTIONAL

ACCESSORIES AND THEIR OPERATION. LUVEVOLVES DBA POWERPLAY CAR

RENTAL EXCLUDES ALL WARRANTIES, BOTH EXPRESS AND IMPLIED, WITH

RESPECT TO THE VEHICLE AND ANY OPTIONAL ACCESSORIES, INCLUDING

ANY IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A

PARTICULAR PURPOSE. Renter agrees not to alter or tamper with Vehicle or

any Optional Accessories. If Renter or AAD(s) determines Vehicle or any

Optional Accessories is unsafe, Renter or AAD(s) shall stop operating Vehicle

and any Optional Accessories and notify Luvevolves DBA Powerplay Car Rental

immediately.

Payment by Renter

a. For items designated as either “/hour”, “/day”, “/week” or “/month” on the

Summary:

(1) “/hour” is 60 consecutive minutes or any portion thereof beginning at the

start time of the rental.

(2) If “day = 24 hour period”, “/day” is each consecutive 24 hours beginning at

the start time of the rental.

(3) If “day = calendar day”, “/day” is each consecutive full or partial day of the

week.

(4) “/week” is 7 consecutive 24 hour days beginning at the start time of the

rental.

(5) “/month” is 30 consecutive 24 hour days beginning at the start time of the

rental.

(6) Unless expressly modified on the Summary, all charges are for a minimum of

1 day.

b. Renter shall pay Luvevolves DBA Powerplay Car Rental, its affiliates or agents

amounts as set forth on the Summary for:

(1) The hour, day, week and month charges on the Summary for the Rental

Period. The “/hour” charge if shown on the Summary shall apply to each full or

partial hour in excess of a day. The hourly charge shall not exceed the cost of

one additional day. If Vehicle is returned during non-business hours or to any

place other than the Branch Address on the Summary, all rental charges

incurred through the time an employee of Luvevolves DBA Powerplay Car Rental

checks in Vehicle are Renter’s responsibility.

(2) The mileage charge per mile for all miles exceeding any free miles set forth

on the Summary permitted for the Rental Period.

(1) If Renter returns Vehicle to a location other than the designated return

location a vehicle recovery fee, unscheduled one way fee or drop charge which

shall be no more than the greater of: a) $300.00; b) $1.50 per mile between

return location and original rental office; or c) Luvevolves DBA Powerplay Car

Rental’s adjusted daily, weekly or monthly rate applicable on the date of return.

Getting Approved to Drive

To rent a vehicle, you must be approved to drive. You must provide us with

identification. You must provide us with accurate, current, and complete

information during the approval process and reserving vehicle process.

Base on the information you provide, Luvevolves DBA may impose

additional requirements for you to reserve a vehicle or use our car rental

services, example (providing a deposit, adding a second form of payment,

buying a certain level of insurance coverage, or other requirements.

Verification

Where permitted, Luvevolves DBA Powerplay Car Rental has the right, but

not the obligation, to o undertake screenings, checks, and engage in processes

designed to (1) help verify the identities or check the backgrounds of Renter and

drivers, including driving history and driver’s license validity and (2) verify

vehicle details. Luvevolves DBA Powerplay Car Rental may in its sole discretion

use third-party services to verify the information you provide to us and to obtain

additional related information and corrections where applicable, and you hereby

authorize Luvevolves DBA Powerplay Car Rental to request, receive, use, and

store such information. Luvevolves DBA Powerplay Car Rental may permit or

refuse your request to reserve, rent, and/or use our car rental services.

Consumer Report Authorization. When you attempt to reserve or rent a

vehicle, or at any time after where Luvevolves DBA Powerplay Car Rental

reasonably believes there may be an increased level of risk renting to you, you

hereby provide Luvevolves DBA Powerplay Car Rental with written instructions

and authorize Luvevolves DBA Powerplay Car Rental, in accordance with the

Fair Credit Reporting Act, applicable consumer reporting laws, or any similar

laws to obtain your personal and/or business auto insurance score, credit

report, and/or conduct a background check, including a criminal background

check where permissible under applicable law.

Fees, Taxes

The fees we charge for using the Rental Car Services or renting our vehicles and

other cost structures will be itemized at checkout for Renter. You can verify the

amount for your vehicle reservation at checkout after you submit your

reservation request. When you provide Luvevolves DBA Powerplay Car Rental a

payment method, you authorize Luvevolves DBA Powerplay Car Rental, or third-

party service providers acting on behalf of Luvevolves DBA Powerplay Car

Rental, to store your payment credential for future use in the event you owe

Luvevolves DBA Powerplay Car Rental any money. You authorize Luvevolves

DBA Powerplay Car Rental to use stored payment credentials for balances,

including for, Reservation cost, and renter fees (e.g., late fees, security deposits,

processing fees and claims costs, and related administrative fees). In some

cases, our payment processors have arrangements with card networks to

automatically update stored payment credentials whenever you receive a new

card (e.g., replacing an expired card or one that was reported lost or stolen) and

we will rely on such updates to stored payment credentials for balances.

Collection of Fees

Luvevolves DBA Powerplay Car Rental and its service providers will employ all

legal methods available to collect amounts due, including the engagement of

collection agencies or legal counsel. Luvevolves DBA Powerplay Car Rental, or

the collection agencies we retain, may also report information about your

Luvevolves DBA Powerplay Car Rental Account to credit bureaus. As a result,

late payments, missed payments, or other defaults on your Luvevolves DBA

Powerplay Car Rental Agreement connected to your car/ vehicle reservation

period may be reflected in your credit report. In addition to the amount due,

delinquent accounts or chargebacks will be charged with fees and/or charges

that are incidental to the collection of delinquent accounts or chargebacks

including, but not limited to, collection fees, convenience fees, and/or other

third party charges. If you wish to dispute the information Luvevolves DBA

Powerplay Car Rental reported to a credit bureau (i.e., Experian, Equifax, or

TransUnion), please contact info@powerplaycarrental.com. If you wish to

dispute the information a collection agency reported to a credit bureau

regarding your Luvevolves DBA Powerplay Car Rental vehicle reservation period,

you must contact the collection agency directly.

In certain jurisdictions, Luvevolves DBA Powerplay Car Rental may enable the

collection and remittance of certain taxes from or on behalf of Renter, based on

existing and future tax regulations.

Your Commitments

You agree that you will always use the car rental Services in compliance with

these Terms, applicable law, and any other policies and standards provided to

you by Luvevolves DBA Powerplay Car Rental.

Prohibited Activities 

In connection with your rental period, you agree that you will not, nor advocate,

encourage, request, or assist any third party to:

Violate any law, including:

•                                                    Breach, violate, and/or circumvent any local, state, provincial/territorial

•                                                    regional, or national law or other law or regulation, or any order of a court,

•                                                    including, without limitation, airport regulations and tax regulations, licensing

•                                                    or registration requirements, or third-party rights

•                                                    Post false, inaccurate, misleading, defamatory, or libelous content

•                                                    Infringe, reproduce, perform, display, distribute, reverse engineer, or prepare

•                                                    derivative works from content that belongs to or is licensed to Luvevolves

•                                                    DBA Powerplay Car Rental, or to a third party, including works covered by any

•                                                    copyrights, trademark, patent, or other intellectual property, privacy, publicity,

•                                                    moral, or contractual rights, except with prior express written permission of

•                                                    Luvevolves DBA Powerplay Car Rental.

•   Vehicle shall not be used for transporting persons for hire; as a school bus; or

for driver training or testing.

In connection with your rental period, you agree that you will not, nor advocate, encourage, request, or assist any third party to:

•   Vehicle shall not be used to carry passengers more than the number of seat belts provided by manufacturer or outside of the passenger compartment.

•   Renter shall not remove any seats from Vehicle.

•   Vehicle shall not be driven by any person impaired by or under the influence of narcotics, alcohol, intoxicants, or drugs, used with or without a prescription.

•   Vehicle shall not be loaded more than Vehicle’s Gross Vehicle Weight Rating (GVWR) which is, weight of Vehicle plus weight of load, as indicated on the

driver side door jam, or with an improperly or unevenly divided load as per Vehicle manufacturer’s specifications and/or guidelines.

•   Renter shall not transfer or assign the Contract and/or sublease Vehicle.

•   Vehicle shall not be used to store or transport explosives, chemicals, corrosives or other hazardous materials or pollutants of any kind or nature.

•   Vehicle shall not be used for testing Vehicle’s technological components or capabilities.

•   Vehicle shall not be used for testing Vehicle’s technological components or capabilities.

Provide or submit any false or misleading information, including:

•                False name, date of birth, driver’s license details, payment method, insurance, or other personal information

•                In relation to a claim (for example about damage to a vehicle

•                Impersonating any person or entity, or falsifying or otherwise misrepresenting yourself or your affiliation with any person or entity

Fail to honor your commitments, including:

•                Fail to pay fees, penalties, or other amounts owed to Luvevolves DBA Powerplay Car Rental

•                Fail, as either a renter, to timely deliver, make available, or return any vehicle and optional Extras

•                Leave a vehicle unlocked or running with the keys inside, except where instructed to do so directly by Luvevolves DBA Powerplay Car Rental in certain limited circumstances

•                Harass, stalk, or defame any other Luvevolves DBA Powerplay Car Rental employee, Luvevolves DBA Powerplay Car Rental, or affiliated agents

•                Engage in physically or verbally abusive or threatening conduct

•                Sue or assert legal claims against Luvevolves DBA Powerplay Car Rental or a Luvevolves DBA Powerplay Car Rental user in any manner prohibited or     waived by these Terms

15. Severability. If any provision of the Contract is determined to be unlawful, contrary to public policy, void or unenforceable, all remaining provisions shall

continue in full force and effect.

Other Legal Matters

Violations. Luvevolves DBA Powerplay Car Rental has the right, but not the obligation, to investigate, pursue, and seek to prosecute, litigate, or refer to law enforcement, violations of the Car Agreement and/or Car Rental Services to thefullest extent permissible by the law.

Policy enforcement. When an issue arises, we may consider the Renter performance history and the specific circumstances in applying our Policies. We

may choose to be more lenient with policy enforcement to do the right thing, subject to our sole and absolute discretion.

Communications with you. You agree that Luvevolves DBA Powerplay Car Rental may contact you by electronic means (e.g., electronic mail; notifications via Luvevolves DBA Powerplay Car Rental messaging; app notification) in lieu of any requirement for mailed notices. To contact you more efficiently, you agree that we may at times also contact you using autodialed or prerecorded message calls or text messages at your phone number(s). We may place such calls or texts primarily to confirm your reservation request, provide notices regarding your Luvevolves DBA Powerplay Car Rental car rental services or Luvevolves DBA Powerplay Car Rental activity, investigate or prevent fraud, collect a debt owed to us, or communicate urgent messages. We may share your phone number(s) with service providers with whom we contract to assist us in pursuing these interests. We will not share your phone number(s) with third parties for their own purposes without your consent. Standard telephone minute and text and data charges may apply. Where Luvevolves DBA Powerplay Car Rental is required to obtain your consent for such communications, you may choose to revoke your consent.

You understand and agree that your communications with Luvevolves DBA Powerplay Car Rental may be overheard, monitored, or recorded.

You authorize Luvevolves DBA Powerplay Car Rental and our service providers,

without further notice, to monitor or record telephone conversations or web chat

interactions you have, or anyone acting on your behalf has, with Luvevolves DBA

Powerplay Car Rental or its agents for quality control, training, or other purposes. You understand and agree that your communications with Luvevolves

DBA Powerplay Car Rental may be overheard, monitored, or recorded. If you do

not wish to have your call recorded, please contact us instead in writing through

info@powerplaycarrental.com If you do not wish to have your chat activity

recorded or monitored, please do not use the chat function on the car Services.

Insurance and protection plans. Luvevolves DBA Powerplay Car Rental is not

an insurance company and does not insure Renter. Available insurance

coverages made available through the Car Services are in no way related. To be

eligible for the benefits of a insurance coverage, Renter must comply with these

Terms. Insurance coverages are available through the Car Services only in the

United States.

Severability. If any provision of the Contract is determined to be unlawful,

contrary to public policy, void or unenforceable, all remaining provisions shall

continue in full force and effect.

Specific Terms for Renter

The following sections also apply during your rental period:

Definitions

"You" or "your" means the person identified as the customer elsewhere in this

Agreement, any person signing this Agreement, any Authorized Driver and any

person or organization to whom charges are billed by us at its or the customer's

direction. All persons referred to as "you" or "your" are jointly and severally

bound by this Agreement.

"We", "our" or "us" means the business named of Luvevolves DBA Powerplay

Car Rental.

"Authorized Driver" means the renter and any additional driver listed by us on

this Agreement, provided that person has a valid driver's license and, is at least

age 21. Only Authorized Drivers may operate the Vehicle.

1.2 "Vehicle" means the automobile or truck identified in this Agreement and

any vehicle we substitute for it, and all its tires, tools, accessories, equipment,

keys and vehicle documents.

1.3 RCP means Renter Collision Protection. "Physical Damage" means damage

to, or loss of, the Vehicle caused by collision. Physical Damage excludes interior

burn holes, window stars or cracks not caused by collision

1.4 "Loss of use" means the loss of our ability to use the Vehicle for any purpose

caused by damage or loss during this rental. Loss of use is calculated by

multiplying the number of days from the date the Vehicle is damaged or lost

until it is repaired or replaced, times the daily rental rate.

1.5 Rental, Indemnity and Warranties. This is a contract for the rental of the

Vehicle. We may repossess the Vehicle at your expense without notice to you, if

the Vehicle is abandoned or used in violation of law or this Agreement. You

agree to indemnify us, defend us and hold us

harmless from all claims, liability, costs and attorney fees we incur resulting

from, or arising out of, this rental and your use of the Vehicle. We make no

warranties, express, implied or apparent, regarding the vehicle, no warranty of

merchantability and no warranty that the vehicle is fit for a particular purpose.

1.6 Renter agrees Renter received the Vehicle and any Extras in good physical

and mechanical condition, unless otherwise identified in Pre-Trip Photos.

1.7 No bailment is or shall be created upon Powerplay Car Rental, whether

actual, constructive or otherwise, for any personal property carried in or left in

the Vehicle car rental premises. Renter acknowledges that any personal data or

information downloaded or transferred to the Vehicle may not be secure and

may be accessible after the Reservation Period. Renter releases Powerplay Car

Rental from any liability resulting from or otherwise arising out of any such data

or information being accessed and/or utilized by a third party.

1.8 Condition and Return of Vehicle. You must return the Vehicle to our stated

drop off location on agreement on the date and time specified in this

Agreement, and in the same condition that you received it, except for ordinary

wear. You must return any extra items, you purchase as apart of the agreement,

such as car seats, etc.  If the Vehicle is returned after closing hours, you remain

responsible for the safety of, and any damage to, or loss of, the Vehicle until we

inspect it upon our next opening for business. Service to the Vehicle or

replacement of parts or accessories during the rental must have our prior

approval. You must check and maintain all fluid levels.

1.9 Renter Insurance plans. The Renter paid insurance plan represents the

amount the Renter must pay in the event of damage to the Vehicle. If the Renter

insurance plan has an “Out-of-Pocket Maximum,” that amount represents the

maximum a Renter will pay Powerplay Car Rental for amounts owed as a result

of damage to the vehicle. Exceptions and exclusions apply. For details please

2.0 Responsibility for Damage or Loss; Reporting to Police. You are responsible

for all loss or theft of, or damage to, the Vehicle, which includes the cost of

repair, or the actual cash retail value of the Vehicle on the date of the loss if the

Vehicle is not repairable or if we elect not to repair the vehicle, plus loss of use,

diminished value of the Vehicle caused by damage to it or repair of it, and our

administrative expenses incurred processing the claim. You must report all

accidents or incidents of theft and vandalism to us and the police as soon as

you discover them.

2.1 Damage Waiver. If you purchase Insurance, and pay for it on return of the

Vehicle to us, we will waive our right to collect from you for a portion of Physical

Damage to the Vehicle. We will not waive this right if damage to the Vehicle: (a)

is caused by anyone who is not an

Authorized Driver, or by anyone whose driving license is suspended in any

jurisdiction; (b) is caused by anyone under the influence of prescription or non-

prescription drugs or alcohol; {¢) is caused by anyone who obtained the Vehicle

or extended the rental period by giving us false, fraudulent or misleading

information; (d) occurs while the Vehicle is used in furtherance of any illegal

purpose or under any circumstance that would constitute a violation of law,

other than a minor traffic violation ; {e) occurs while carrying persons or

property for hire or while pushing or towing anything, or in any race, speed test

or contest; (f) occurs while teaching anyone to drive; (g) occurs while carrying

dangerous or hazardous items or illegal materiel in or on the Vehicle; (h) occurs

outside the geographic limitations indicated on the reverse; (i) occurs when it is

loaded beyond its capacity; (j) occurs as a result of driving the Vehicle on

unpaved roads; (k) occurs while transporting more persons than the Vehicle has

seat belts, or while carrying persons outside the passenger compartment; (I)

occurs while transporting children without approved child safety seats as

required by law; {m) occurs and the odometer has been tampered with or

disconnected; (n} occurs when the vehicle's fluid levels are low, or it is

otherwise reasonable to expect you to know that further operation would

damage the vehicle; {o) results from inadequately secured cargo; (p) where

applicable, is caused by anyone who lacks experience operating a manual

transmission; (a) is a result of your willful, wanton or reckless act; (r) occurs

and you fail to summon the police to any accident involving personal injury or

property damage; or, (s) is caused by an animal transported in the Vehicle.

2.2 Insurance. You are responsible for all damage or loss you cause to others.

You agree to provide auto liability, collision and comprehensive insurance

covering you, us and the Vehicle. Where state law requires us to provide auto

liability insurance, or if you have no auto liability insurance, we provide auto

liability insurance (the “Policy”) that is secondary to any other valid and

collectible insurance whether primary, secondary, excess or contingent. The

Policy provides bodily injury and property damage liability coverage with limits

no higher than minimum levels prescribed by the vehicular financial

responsibility laws of the state whose laws apply to the loss. You and we reject

PIP, medical payments, no-fault and uninsured and under-insured motorist

coverage, where permitted by law. The Policy is void if you violate the terms of

this Agreement, or if you fail to cooperate in any loss investigation conducted by

us or our insurer.

2.3 Charges. You will pay us, or the appropriate government authorities, on

demand all charges due us under this Agreement, including, but not limited to:

(a} time and mileage for the period you keep the Vehicle, or a mileage charged

based on our experience if the odometer is tampered with or disconnected; (b)

DBA Powerplay Car Rental’s prior written consent. Vehicle should not be taken outside of USA.

2.4 Accidents. Damage to, loss or theft of, Vehicle must be immediately

reported in writing to the office where Vehicle was rented, and in no event later

than the following business day after the accident. Renter and AAD(s) must

immediately deliver to the office where Vehicle was rented every process,

pleading or paper relating to any claims, suits or proceedings arising from such

accident. In the event of a claim, suit or legal proceeding, Renter, AAD(s) and all

other parties seeking benefits pursuant to this rental contract shall cooperate

fully with Luvevolves DBA Powerplay Car Rental and its representatives. Renter

shall be responsible for assisting Luvevolves DBA Powerplay Car Rental in

obtaining any necessary cooperation from an AAD. Cooperation shall Include,

but not be limited to, consent to: (i) examinations under oath at Luvevolves DBA

Powerplay Car Rental’s or Luvevolves DBA Powerplay Car Rental’s

representatives’ request and furnishing a signed statement of testimony. and;

(ii) request for statements, written or oral, and/or other matters Luvevolves DBA

Powerplay Car Rental or its representatives deems related to the adjustment of

any claim, suit or proceeding. Vehicle may be equipped with an Event Data

Recorder (EDR), infotainment system and/or similar technology for the purpose

of recording data about the operation and/or use of Vehicle. To the extent

permitted by law, Renter consents to Luvevolves DBA Powerplay Car Rental or

its representatives retrieving and using such data from the EDR or otherwise,

including during the adjustment of any claim, suit or legal proceeding.
